The EB-5 Regional Center Program is officially extended until December 8, 2017. The extension was expected after the summer recess due to other congressional priorities.
The extension of the Regional Center authorization allows (USCIS), to continue to process applications until December 8, 2017 or until further legislative action.
There are advantages to filing under current provisions, but potential investors should seek legal guidance and evaluate the risks carefully.
This extension now gives Congress more time to decide on possible regulatory changes, as well as a permanent solution for the (EB-5) program. Also , the extension on (EB-5) Visa program has given investors as well as potential applicants an opportunity to file petitions before guidelines change at the end of the year.
The fact that the program is extended to December 8, 2017 does not guarantee that the program will remain unchanged until that date. It’s possible that Congress could pass legislation before December that would affect the EB-5 visa category. There is also the possibility that the Department of Homeland Security (DHS) will issue the proposed regulations that were published in January, which would possibly increase the investment amount in a TEA to $1,350,000 and in other areas to $1.8 million.
