NO REAUTHORIZATION FOR THE REGIONAL CENTER PROGRAM IN DECEMBER 2021
On December 3rd, 2021, President Joe Biden approved a stopgap spending bill, delaying a government shutdown as well as funding the federal government all the way through February 18, 2022. For investors and EB-5 industry stakeholders, that means prospects for EB-5 Immigrant Investor Regional Center Program reauthorization have now been pushed back yet again. This is a disappointed for our clients and for all other EB-5 investors and their families who have been waiting unreasonable lengths of time for their cases to move forward.
The EB-5 Immigrant Investor Regional Center Program expired on June 30, 2021. As of today, EB-5 Immigrant Investor Regional Center Program has been suspended for more than five months. Hopes were that the reauthorization would take place sooner rather than later.
POTENTIAL POSITIVE OPPORTUNITIES FOR EB-5 INVESTORS
The good news is there may be an approval by U.S. Congress and/or United States Citizenship and Immigration Services (USCIS) and/or the U.S. State Department for grandfathering in all pending EB-5 Immigrant Investor Regional Center petitions and CPR Applications filed under the EB-5 Immigrant Investor Regional Center Program, so that they may continue to be processed even though the EB-5 Immigrant Investor Regional Center Program has not been reauthorized.
AN OPPORTUNITY FOR DIRECT EB-5 INVESTMENT
World will not subject to any visa waiting lists. It is the first time since the EB-5 visa categories became oversubscribed in 2015 that the EB5 Direct program becomes current for investors from the People’s Republic of China, which has been subject to an EB-5 waiting list since May 2015. It’s also the first time that Direct EB-5 applicants and Regional Center EB-5 applicants have different cut-off dates.
EB-5 VISA IN A NUTSHELL:

To receive the EB-5 visa, you must invest at least USD 500,000 in a US enterprise and create at least 10 American jobs.

If you are eligible for the EB-5 Visa, you receive a Green Card and you are allowed to live in the US.

You can include your dependent family members in the application. This means your spouse and children under 21Y also get Green Cards.

The US only issues 10,000 EB-5 Investment Visas per year. This also includes the visas issued to family members.
