USCIS - recently released quarterly statistics for the fourth quarter(Q4) of fiscal year (FY) 2020 for Form I-526. While filings are slightly up from last quarter, the data shows that per-quarter filings are still extraordinarily lower than recent years.

On December 3, 2018 House Appropriations Committee Chairman Rodney P. Frelinghuysen introduced H.J. Res 143 – FY 2019 Continuing Resolution Through December 21, 2018 to extend government programs for the fiscal year until December 21, 2018.

The (EB-5) program, which was set to expire on September 30, 2018 has been extended again until the beginning of December (after midterm elections) . On Friday September 28, 2018 President Trump signed a spending package that includes a short-term continuing resolution (CR) extending the EB-5 Regional Center Program through December 7, 2018.

After multiple extensions, the EB-5 visa program is set to expire on September 30th, 2018. If you can complete preparations for your EB-5 investment in the next 60 days, you have a reasonable chance of getting the I-526 petition filed before any changes take effect. Now is the time to do so under the current rules.

As an EB-5 permanent resident, when you get a green card, you are affirming that you wish to permanently reside in the United States (U.S.). Thus, it is advisable to stay in the U.S. as long as and for as many days as you are able. However, many EB-5 permanent residents may need to spend most of the time back in their home country for business purposes. In this situation, you must obtain a re-entry permit before you leave U.S.
