U.S. EB-5 Program

As we did post last week , there were negotiations to fund the federal government . However , a continuing resolution that would have funded the U.S. government and extend several immigration programs until February 16th 2018 has failed in the Senate.

Congress failed to pass a budget, shutting down the federal government except for certain “essential” functions. Having said that , nonessential government services have shut down as of 12 AM January 20th 2018 , triggering a severe impact on immigration programs and processes. Importantly, the EB-5 Regional Center program has come to a halt .

By a vote of 266-150 on January 22th  2018  (three days after the previous extension deadline of midnight on January 19th ), the House passed the Senate amendment, extending Continuing Appropriations for government services and programs to February 8th  2018. The bill now goes to the president who is expected to sign it into law.

Today’s action extends government operations and programs until February 8th 2018, including vital immigration programs such as EB-5 program .

It does worth it to note that any lapse in the Regional Center program will have no effect on:

• Forms I-526 filed without a Regional Center (direct EB-5 filings);
• Investors who have already achieved conditional permanent resident status; OR
• Any Form I-829 filings, whether or not filed based on a Regional Center investment.
